These Terms of Service ("Terms") establish the conditions for using the English composition application MomenTalk ("App") and the services provided by the App (hereinafter collectively referred to as the "Services", which include the App). Users of the Services ("Users") agree to use the Services in accordance with these Terms.

Intellectual Property Rights

The copyrights and other intellectual property rights related to the Services belong to the developer of the Services. The intellectual property rights for content generated by the AI used within the Services belong to the third party holding those rights.

Privacy

The Services will handle personal information appropriately in accordance with the Privacy Policy separately established by the Services.

Prohibitions

Users are prohibited from engaging in the following actions when using the Services:

- Actions that violate laws or public order and morals

- Actions that may interfere with the operation of the Services

- Actions that infringe on copyrights or other intellectual property rights contained in the Services

- Actions involving reverse engineering of the Services

- Unauthorized access to servers used by the Services, causing system disruptions

- Actions that place an excessive load on the servers used by the Services, or actions that intentionally use server-communication-based features within the Services (e.g., question sentence generation, answer review) at an excessively frequent rate.

- Other actions deemed inappropriate

Restriction of Use

If a user violates any of the provisions of these Terms, the Services may restrict or terminate the user's access to all or part of the Services without prior notice.

Changes or Suspension of Services

The Services may modify, interrupt, suspend, or terminate part or all of the Services at any time for any reason without prior notice to Users.

Limitation of Liability

- The Services are not liable for any damages incurred by Users in connection with their use of the Services.

- The Services provide no guarantees regarding completeness, accuracy, applicability, usefulness, availability, safety, or reliability.

- The Services are not responsible for compensating for any damages caused by malfunctions, errors, or failures that result in the Services being unavailable or not functioning properly.

- The Services are not liable for damages incurred by Users as a result of actions taken in accordance with these Terms.

- The Services are not responsible for transactions, communications, or disputes between Users or between Users and third parties in connection with the Services.

- Notwithstanding other provisions in these Terms, if the Services are liable for damages due to breach of contract or tort, the liability is limited to the equivalent of one month's fee for the paid service being used by the User at the time of the damage, except in cases of intentional or gross negligence. The Services are not liable for damages arising from special circumstances, even if such damages were foreseeable.

Changes to the Terms

The Services may amend these Terms at any time without notice or consent from Users. The amended Terms will take effect immediately upon modification.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Services' headquarters.
